Introduction
This Privacy Policy outlines SAYF & YSSPA (" we ", " our " or " the Company ") practices with respect to information collected from users who access our website at www.sayfyoga.com (" Site "), or otherwise share personal information with us (collectively: " Users ").
Grounds for data collection
Processing of your personal information (meaning, any information which may potentially allow your identification with reasonable means; hereinafter " Personal Information ") is necessary for the performance of our contractual obligations towards you and providing you with our services, to protect our legitimate interests and for compliance with legal and financial regulatory obligations to which we are subject.
When you use the Site, you consent to the collection, storage, use, disclosure and other uses of your Personal Information as described in this Privacy Policy.
We encourage our Users to carefully read the Privacy Policy and use it to make informed decisions.
What information we collect?
We collect two types of data and information from Users.
The first type of information is un-identified and non-identifiable information pertaining to a User(s), which may be made available or gathered via your use of the Site (“ Non-personal Information ”). We are not aware of the identity of a User from which the Non-personal Information was collected. Retention
We will retain your personal information for as long as necessary to provide our services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. Under applicable regulations, we will keep records containing client personal data, account opening documents, communications and anything else as required by applicable laws and regulations.
We may rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion.

We do not combine the information collected through the use of Google Analytics with personally identifiable information. Third party collection of information
Our policy only addresses the use and disclosure of information we collect from you. To the extent you disclose your information to other parties or sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. This Privacy Policy does not apply to the practices of companies that we do not own or control, or to individuals whom we do not employ or manage, including any of the third parties which we may disclose information as set forth in this Privacy Policy.
How do we safeguard your information?
We take great care in implementing and maintaining the security of the Site and your information. Although we take reasonable steps to safeguard information, we cannot be responsible for the acts of those who gain unauthorized access or abuse our Site, and we make no warranty, express, implied or otherwise, that we will prevent such access.
Transfer of data outside the EEA
Please note that some data recipients may be located outside the EEA. In such cases we will transfer your data only to such countries as approved by the European Commission as providing adequate level of data protection, or enter into legal agreements ensuring an adequate level of data protection.
Marketing
We may use your Personal Information, such as your name, email address, telephone number, etc. ourselves or by using our third party subcontractors for the purpose of providing you with promotional materials, concerning our services, which we believe may interest you.
Out of respect to your right to privacy we provide you within such marketing materials with means to decline receiving further marketing offers from us. If you unsubscribe we will remove your email address or telephone number from our marketing distribution lists.
Please note that even if you have unsubscribed from receiving marketing emails from us, we may send you other types of important e-mail communications without offering you the opportunity to opt out of receiving them. These may include customer service announcements or administrative notices.
Corporate transaction
We may share information in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, consolidation or asset sale). In the event of the above, the transferee or acquiring company will assume the rights and obligations as described in this Privacy Policy.
Minors
We understand the importance of protecting children’s privacy, especially in an online environment. The Site is not designed for or directed at children. Under no circumstances shall we allow use of our services by minors without prior consent or authorization by a parent or legal guardian. We do not knowingly collect Personal Information from minors. Updates or amendments to this Privacy Policy
We reserve the right to periodically amend or revise the Privacy Policy; material changes will be effective immediately upon the display of the revised Privacy policy. The last revision will be reflected in the "Last modified" section. Your continued use of the Platform, following the notification of such amendments on our website, constitutes your acknowledgment and consent of such amendments to the Privacy Policy and your agreement to be bound by the terms of such amendments.

Agreement between User and www.SAYFyoga.com
Welcome to www.SAYFyoga.com.
The www.SAYFyoga.com website (the "Site") is comprised of various web pages operated by Sustainable Asana Yoga Foundation, LLC ("SAYF"). www.SAYFyoga.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of www.SAYFyoga.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.
www.SAYFyoga.com is an online Yoga Asana Training and Certification Site.
The SAYF yoga website provides online training and certification in sustainable techniques and essential human movement knowledge to assist yoga asana instructors, studios and practitioners prevent injury and long term degenerative that may get in the way of successful yoga asana practice.
Our certification is a 20 hour online training put together with the expertise and experience of the SAYF board of advisers combined knowledge in biomechanics, human movement, exercise science and yogic tradition.
Privacy
Your use of www.SAYFyoga.com is subject to SAYF's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
Electronic Communications
Visiting www.SAYFyoga.com or sending emails to SAYF constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
Your Account
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that SAYF is not responsible for third party access to your account that results from theft or misappropriation of your account. SAYF and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.
Children Under Thirteen
SAYF does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use www.SAYFyoga.com only with permission of a parent or guardian.
Cancellation/Refund Policy
No refunds are provided for purchases. Student can review the course and retake the test as many times as necessary to achieve certification within 1 year of purchase.
Once certification is attained it will expire within 2 years without renewal. The student is responsible for renewing their certification to continue to receive the benefits of membership to the SAYF foundation and certification.
Links to Third Party Sites/Third Party Services
www.SAYFyoga.com may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of SAYF and SAYF is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. SAYF is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by SAYF of the site or any association with its operators.
Certain services made available via www.SAYFyoga.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the www.SAYFyoga.com domain, you hereby acknowledge and consent that SAYF may share such information and data with any third party with whom SAYF has a contractual relationship to provide the requested product, service or functionality on behalf of www.SAYFyoga.com users and customers.
No Unlawful or Prohibited Use/Intellectual Property

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. SAYF content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of SAYF and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of SAYF or our licensors except as expressly authorized by these Terms.
International Users
The Service is controlled, operated and administered by SAYF from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the SAYF Content accessed through www.SAYFyoga.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
Indemnification
You agree to indemnify, defend and hold harmless SAYF, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. SAYF reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with SAYF in asserting any available defenses.
ARBITRATION AGREEMENT WITH CLASS ACTION WAIVER
Any claim or dispute with Sustainable Asana Yoga Foundation, LLC (SAYF, LLC) shall be conducted only on an individual basis and not in a class, collective or representative action or as a named or unnamed member in a class, collective, consolidated or private attorney general action. All claims and disputes arising from or relating to the information, software, products and services provided by SAYF, LLC shall be decided by arbitration in accordance with rules of the American Arbitration Association then in effect, unless I and the SAYF, LLC in writing, mutually agree otherwise.
To the extent permitted by law, this Agreement covers all claims and disputes with SAYF, LLC, including but not limited to all claims arising in tort or in contract, and all claims arising from or relating to federal, state, or local statutes or ordinances. This Agreement covers all claims I may bring against agents of SAYF, LLC.
To the extent that arbitration of any specific claim is prohibited by law, all other claims shall nonetheless be submitted to arbitration.
Notice of the demand for arbitration shall be served in writing and shall be filed with the American Arbitration Association. Notice shall be served and filed within six months of the time the claim or dispute arose, except in the case of statutory rights described in paragraph 2 of this Agreement. Notice shall be served and filed in such statutory cases within the time limit established by the statute(s) or ordinance(s) at issue.
The place of arbitration shall be Hood River, Oregon or its surrounding suburbs.
The cost of the arbitration hearing shall be shared equally by the parties to the extent permitted by law. Each side shall be responsible for its own attorney's fees, costs and disbursements to the extent permitted by law. The matter will be decided by one arbitrator.
The award rendered by the arbitration or arbitrators shall be final, and judgment may be entered upon it in accordance with Oregon law in a court having jurisdiction thereof. This agreement to arbitrate shall be specifically enforceable under Oregon law and under the Federal Arbitration Act in a court having jurisdiction thereof.
LIABILITY DISCLAIMER
Sustainable Asana Yoga Foundation, LLC (hereinafter SAYF, LLC) and/or its suppliers make no representations about the suitability, reliability, availability, timeliness, and/or accuracy of the information, software, products, services and related graphics contained on the SAYF, LLC website (hereinafter “site”) for any purpose. To the maximum extent permitted by law, all such information, software, products, services and related graphics are provided “as-is” without any warranty or condition of any kind. SAYF, LLC and/or its suppliers hereby disclaim all warranties (including all implied warranties or conditions of merchantability, fitness for a particular purpose, title and non-infringement) and conditions with regard to this information, software, products, services and related graphics.
The information, software, products, services and related graphics included on or available through the SAYF, LLC site may include inaccuracies or typographical errors. SAYF, LLC and/or its suppliers may make improvements and/or changes on the site at any time.
To the maximum extent permitted by law, SAYF, LLC and/or its suppliers shall not be liable for any direct, indirect, punitive, incidental, special, consequential or other damages based on contract, tort, negligence, strict liability or otherwise, including, without limitation, damage for: loss of use, data or profits arising out of the use or performance of the site; delay or inability to use the site or related services; the provision or failure to provide services; information, software, products, services and related graphics obtained through the site or through use thereof; or otherwise arising out of the use of the site. The sole and exclusive remedy for any dissatisfaction with the site or its terms of use is to discontinue use of the site.
Termination/Access Restriction
SAYF reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Oregon and you hereby consent to the exclusive jurisdiction and venue of courts in Oregon in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and SAYF as a result of this agreement or use of the Site. SAYF's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of SAYF's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by SAYF with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and SAYF with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and SAYF with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms
SAYF reserves the right, in its sole discretion, to change the Terms under which www.SAYFyoga.com is offered. The most current version of the Terms will supersede all previous versions. SAYF encourages you to periodically review the Terms to stay informed of our updates.
